NAMWOLF LAW FIRM DEFEATS NATIONAL CLASS ACTION BY SUMMARY JUDGMENT IN ACTION BROUGHT UNDER THE FLSA

The United States District Court for the Middle District of Florida granted summary judgment on May 1, 2018 with respect to a motion made by the law firm Schroder, Joseph & Associates, LLP, in an action seeking overtime pay for a national class of truck drivers who deliver Carvel® ice cream cakes and other frozen desserts for the Rich Product Corporation of Buffalo, New York. The motion was made after the close of discovery. District Court Judge Susan C. Bucklew found in Scott Erhlich et al. v. Rich Products Corporation, Case 8:16:03532-SCB-TGW, Docket No. 54 (M. D. Fla. May 1, 2018), that the Defendant had met is burden to demonstrate that the Motor Carrier Act Exempt applied by reason of the undisputed facts and, therefore, entered judgment in favor of Defendant dismissing the action which has sought overtime pay for the class under the Fair Labor Standards Act. Lead counsel for the Defendants was Linda H. Joseph of Schröder, Joseph & Associates, LLP whose office is in Buffalo, New York.
